Terms of Use

1. About the Foundation

The Foundation is a California Nonprofit Public Benefit Corporation. EIN pending — tax-deductibility pending IRS determination. We provide therapeutic painting programs for wounded warriors, kids on the autism spectrum, hospital and hospice patients and families, foster youth, seniors, and others on a sliding-scale basis.

2. Donations

• Donations are processed through our third-party payment processor. Donation amounts shown at checkout are final.
• Tax-deductibility of donations depends on the Foundation's IRS determination status; current status is shown on this Site and on donation receipts.
• Recurring donations may be canceled at any time by emailing us at the address below or following the unsubscribe link in your donor email.
• Refunds for genuinely mistaken donations may be requested within 30 days; we will work with you in good faith on clearly mistaken charges.

3. Program enrollment

• Programs are offered on a sliding-scale basis. If you cannot afford to participate, you do not pay.
• Programs serving minors require a parent or guardian to consent and provide accurate contact information.
• We may decline or end participation in a program if conduct endangers participants, staff, or volunteers.
• Some programs are held in third-party venues (hospitals, hospice facilities, schools, Regional Center sites) with their own rules; attendance is conditional on following those rules.

4. Acceptable use of the Site

You agree not to:

• Use the Site for any unlawful purpose.
• Harass, threaten, impersonate, or defame anyone through the Site or any form on it.
• Attempt unauthorized access to the Site or its supporting infrastructure.
• Interfere with the Site through automated traffic, scraping, or denial-of-service attempts.
• Submit donations, signups, or contact-form messages on behalf of someone else without their consent.

5. Volunteer relationship

Volunteers are not employees of the Foundation. Volunteers agree to follow program guidelines, safeguarding requirements for working with vulnerable participants, and the venue rules of any partner facility.

6. Photography and recording

We sometimes photograph or record programs for documentation, grant reporting, and outreach. We obtain a separate written consent for any identifiable photography of minors. If you (or your child) do not wish to be photographed, please tell the program lead on arrival and we will accommodate.

7. Intellectual property

Site content, logos, and program names belong to the Foundation or its licensors. Artwork created by program participants belongs to the participant; we may request permission to display program artwork for outreach.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE FOUNDATION OR ITS DIRECTORS, OFFICERS, VOLUNTEERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PARTICIPATION IN A PROGRAM.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Orange County, California.

11. Changes

We may update these Terms from time to time. Material changes will be announced on the Site and the effective date above will be updated.
